Negotiation and Mediation can often be difficult, with unexpected ethical issues arising without warning. We will examine common negotiation scenarios that highlight ethical dilemmas for attorneys and mediators. We will also review ethical issues that may arise for attorney litigators when litigating outside the mediation process.

The presentation addresses ethical challenges that arise in dispute resolution practice and reviews professional responsibilities applicable to attorneys, mediators, and ADR professionals.
