SNCO DOC Competency Restoration Program: Why, Who, How, and When

About the Program:
This CLE will introduce Shawnee County’s newly developed Competency Restoration Program, set to launch later this spring. A must-attend for anyone practicing criminal law in Shawnee County, this session will offer a legal and clinical overview of competency procedures, recent developments, and the collaborative efforts behind implementing the local CST (Competency to Stand Trial) program.
Led by District Court Judge Maban Wright, with contributions from Major Timothy Phelps and other key partners, this program begins with a review of K.S.A. 22-3301 et seq., exploring the lifecycle of a competency action and highlighting updated 3302 and 3303 forms and procedures. Following this legal context, presenters will detail the structure, procedures, and goals of the SNCO DOC’s new program, including eligibility, staffing, medication pathways, and legal intersections such as Medication Over Objection.
Members of the DOC and behavioral health teams involved in this initiative will be present to answer questions, discuss practical challenges, and collaborate with attendees to help shape this evolving area of criminal practice.
