“Call the Sommelier – I need a decanter!”
In its 2023-2024 session, the Kansas legislature enrolled and presented to the Governor House Bill 2172, which became law effective July 1, 2023. The bill contained multiple provisions related to trusts, but the focus of this presentation will be those enacting the uniform trust decanting act (the “UTDA”.) The purpose of the UTDA is to provide a statutory framework for decanting an otherwise irrevocable trust to a new trust framework, while maintaining guard rails to protect the settlor’s intent and rights of the beneficiaries. This webinar will highlight the essential terms and new statutory definitions in this Act to help acquaint practitioners with this new tool.

Emily has been practicing in the areas of elder law and estate planning for twenty years, is a Certified Elder Law Attorney (CELA) by the National Elder Law Foundation and holds an advanced degree in Estate Planning (LL.M.). She is a member of the Special Needs Alliance, an invitation only national non-profit collective of leading disability and public benefits attorneys. She is an adjunct professor at Washburn University School of Law, for the Elder Law course, and at the University of Kansas School of Law, for Estate Planning Principles and Practice. She is a member of the Probate Law Advisory Committee of the Kansas Judicial Council; and a frequent author and speaker on issues affecting the aged and individuals with disabilities. Most importantly, it has been her greatest honor to serve as caregiver and long-term care planner for four dogs adopted during their mid to golden years – each of which has tried to teach her the true meaning of life.
