E-Discovery Updates: What you may know, what you may not know, and a view from the bench

Presenter: Hon. Lori Dougherty - Bichsel

This program will discuss the advancements in e-discovery, including review of recent federal and state rulings in the last year regarding artificial intelligence in discovery. The program will discuss the effects of these advancements on K.S.A. 60-226, 60-234, and 60-237, and the corresponding federal rules (FRCP 26, 34, and 37). The program will discuss key changes of December 1, 2025 amendments to FRCP 26 and its potential impact on an attorney’s discovery plans (and privilege issues), as well as how that corresponds to Rule 16. The program will briefly touch on the ethical considerations and potential privileges when an attorney uses artificial intelligence in their practice. We will wrap up with some examples of judicial perspective on e-discovery disputes and questions attorneys should be prepared to answer during a hearing.
